North Pension Fund Summary Plan Description (SPD)
>> Non-Assignment of Benefits
The Plan prohibits a Participant, Retiree, Beneficiary or Surviving
Spouse from assigning, transferring, selling, mortgaging, or pledging
pension benefits. However, the law provides an exception for Qualified
Domestic Relations Orders (“QDROs”). When the Fund receives any
judgment, decree, or order (including approval of a property settlement
agreement) that requires the Plan to pay benefits to an Alternate Payee,
as defined below, pursuant to a state domestic relations law, the Plan
will notify the Participant and the Alternate Payee of the receipt of that
judgment and the procedures for determining whether it is a QDRO.
An Alternate Payee means any Spouse, former Spouse, child, or other
dependent of a Participant recognized by a domestic relations order as
having a right to receive all, or a portion of, the benefits payable under
the Plan. To the extent provided in any QDRO, the former Spouse of a
Participant can be treated as the Surviving Spouse for purposes of the
Qualified Joint and Survivor Annuity and Pre-Retirement Husband and
Wife Benefit if the former Spouse and Participant were married for at
least one year as of the date of divorce.
